  1. Primero. RECHAZAR por improcedente la solicitud de apertura de incidente de desacato de la Sentencia T-1045 de 2007, promovida por la señora Gilma Vargas Peña.
  2. Segundo. INFORMAR a la señora Gilma Vargas Peña que el Juzgado Treinta y Nueve Penal del Circuito de Bogotá, es el competente para conocer del incidente de desacato de la Sentencia T-1045 de 2007.
  3. Tercero. ORDENAR la remisión del escrito de solicitud de apertura de incidente de desacato de la Sentencia T-1045 de 2007 al Juzgado Treinta y Nueve Penal del Circuito de Bogotá, para que proceda conforme con sus competencias en la materia.
